In this privacy policy, the terms Intervest, we and us refer to Intervest Offices & Warehouses, located at Uitbreidingsstraat 66, 2600 Berchem, with company number 0458.623.918.

1. To whom does this privacy policy apply? 

This privacy policy applies to Intervest’s processing of the personal data of tenants (including their appointees, e.g. employees and contractors) within the context of the services that Intervest provides to tenants (hereinafter the “Services”).

2. Which personal data do we process?

As part of the Services, we may collect and process the following personal data about you:

  • Personal identification information (e.g. name, email address, telephone number, address);
  • Financial data (e.g. bank account number);
  • Professional data (e.g. job title, department name, manager name);
  • Electronic identification data (e.g. IP number, online login data).

 

3. Why do we process your personal data?

We process your personal data so that we can provide the Services. For example, among other things we process your personal data with a view to:

  • Customer Relationship Management;
  • Advertising, PR and marketing;
  • Order processing (including shipment of goods);
  • Processing of accounts and accounting;
  • Business development;
  • Demand planning and production;
  • Customer support;
  • Product support and guarantees;
  • Organisation of events;
  • Management of (possibly legal) disputes.

 

4. Legal basis for processing

We process your personal data:

  • when this is necessary for the execution of the agreement we have with you;
  • when this is necessary to comply with a legal obligation applicable to us;
  • when this is necessary to defend our legitimate interests, insofar as your fundamental rights and freedoms do not override those interests (e.g. if we need your data for internal administrative purposes, to guarantee the security of the network and the data or to prevent fraud);
  • when you have agreed to it, for example when you have consented to voluntary participation in a satisfaction survey.

 

5. Who has access to your personal data?

In connection with the Services, we may share your personal data with:

  • our offices / other entities of the Greenhouse group;
  • our business partners;
  • public services (including justice and police services);
  • banks and insurers;
  • our professional advisers (e.g. law firms and consultancy firms);
  • IT-related service providers.

We will also disclose your data to third parties:

  • if we sell or buy a business or assets, where we will disclose your data to the potential seller or buyer of such business or assets;
  • if Intervest or almost all of its assets are taken over by a third party, whereby Intervest’s customer data may be part of the transferred assets;
  • if we are obliged to disclose or share your data in order to comply with a legal obligation or to protect the rights, property or safety of Intervest, our customers or others.

6. Transfer of your personal data

We may transfer your personal data to a destination outside the European Economic Area (EEA) if appropriate (i) to achieve one of the purposes set out in section ‎3 and/or (ii) to disclose your data to a third party in accordance with section 5 of this privacy policy.
If your data are transferred outside the EEA, we will ensure that your data are protected using the following security mechanisms:

  • the laws of the country to which your data are transferred ensure an appropriate level of data protection (Article 45 GDPR); or
  • the transfer falls under the data protection clauses (Article 46.2 GDPR) approved by the European Commission or under the EU-US Privacy Shield; or
  • the transfer is based on binding corporate rules (Article 47 GDPR), an approved code of conduct (Article 40 GDPR), an approved certification mechanism (Article 42 GDPR), an approved data transfer agreement (Article 46.3 GDPR), or data protection clauses adopted by the Belgian Data Protection Authority (Article 46.2 GDPR).

3. Right to rectification You have the right to request that we modify your personal data if they are incorrect or incomplete.
4. Right to erasure In certain circumstances, you have the right to request that your personal data be erased or deleted from our systems.
5. Right to restrict processingYou have the right to block or stop further use of your personal data in certain circumstances. Where processing is restricted, we can still retain your personal data, but not use them further.
6. Recht op overdraagbaarheid van gegevensIn certain circumstances, you have the right to obtain your personal data in a structured, commonly used and machine-readable form, so that you can reuse these data for your own purposes for different services.
7. Right to object to processingIn certain circumstances, you have the right to object to a certain processing. In particular, where such processing is based on our legitimate interests or is based on the public interest; when we process your personal data for direct marketing purposes (including profiling) or when we process your personal data for scientific or historical research purposes or statistical purposes in certain circumstances.

Right to withdraw your consent If you have consented to something we do with your personal data, you have the right to withdraw this consent at any time (however, this does not mean that anything we have previously done with your personal data - with your consent - is unlawful). This includes, among other things, your right to withdraw your consent for the use of your data for direct marketing purposes.

How long do we retain your personal data?

We keep your personal data for as long as we provide Services to you, unless:

  • we need your personal data in the context of a current or potential dispute (for example, we need these data to initiate or defend legal claims), in which case we will retain your personal data until the end of such dispute; and/or
  • we must keep your personal data in order to comply with any legal or regulatory obligation (e.g. for tax purposes), in which case we will retain your personal data for as long as required by that obligation.

 

8. What happens if you do not provide the data we requested or if you request that we stop processing your data?

Our ability to comply with:

  • our obligations under our agreement with you or
  • the legal obligations applicable to us

sometimes depends on the ability to access and use certain personal data about you. Consequently, the fact that you do not provide us with certain personal data may cause us to breach one or more applicable legal or contractual obligations or prevent us from performing the Services.

9. Automated decision-making

We do not use your personal data for any automated decision-making.
